Short version:

At MEDiCARE, we take privacy seriously.

The categories of personal data that we process depends on how you use our services. We use your personal data to provide our online services in alignment with your preferences, to process your requests, to contact you regarding products and services which may be of interest to you, to provide prize draws or competitions, or to carry out relevant administrative services. All personal data is processed in accordance with applicable data protection laws.

We only disclose your personal data to third parties that assist us with providing you with our services and, if you authorise us explicitly, to our affiliated companies for the purpose of customer relationship management, analytics and marketing.

With your consent we also use cookies for marketing, performance and statistical purposes.

MEDiCARE Myanmar is committed to safeguarding your privacy and ensuring that your personal data is protected in relation to the operation of our retail business.

This Privacy Policy Statement explains the types of personal data we collect and how we process and protect that data.

We shall keep your personal data confidential and shall ensure that our policies and practices with respect to the collection, use, retention, disclosure, transfer, security and access of your personal data comply with the laws of Myanmar.

1. Personal data: what we collect and why

1.1. In order for you to become a Registered Customer / Member, and/or to enjoy our various products and services, it is necessary for you to provide us with certain essential personal data as indicated at the time of collection.  The types of personal data we may collect include your name, address, email address, telephone/mobile number, date of birth, gender, age, shopping preferences and hobbies.

1.2. Depending on each service and/or other specific collection purposes, from time to time, we may require you to provide some additional information to ensure your use of the service, or to ensure that contact and transactions between parties are smooth and convenient.

1.3. We shall have the right to collect, hold, process and/or use, the personal data in each case for the purposes as set out in, and in accordance with this Privacy Policy Statement.  If you are unable or unwilling to provide us with complete and correct Personal data, we may not be able to provide or continue to provide our products and services to you.

2. Use of your personal data

2.1. You agree that the personal data you provide to us and all information relating to the use of our website and/or our Loyalty Program may be used and retained by us for:

  1. Processing your application as a Registered Customer / Member;
  2. Providing you with our services; 
  3. The normal management, operation, and maintenance of our Website and/or our Loyalty Program;
  4. Providing you with regular communications from us with details of our products and services, our retail business and relevant benefits;
  5. Processing your order for purchases at our stores and/or our website, including verifying your payment details/status and arranging delivery;
  6. Carrying out prize draws, games or competitions which you have entered;
  7. Carrying out data sorting and analysis to enable us to better understand your characteristics and buying behaviour and to provide other services better tailored to your needs, and to assist us in selecting products or services that are likely to be of interest to you;
  8. Designing new, or improving existing, services provided by us to you;
  9. Aggregated behavioural analysis;
  10. Investigation of complaints, suspicious transactions, and research for service improvement;
  11. Prevention or detection of crime; and
  12. Disclosure as required by law.

2.2. With your consent or indication of no objection, we will use your personal data for marketing to you (whether by posts, emails, phone calls, SMS, or other media whether now known or available in the future) in relation to offers and promotions from us, to provide products, services and/or our retail business updates and benefits to you.

2.3. We may disclose and transfer (whether in Myanmar or abroad) your personal data to:

a) Our Affiliates;

b) Our agents or contractors under a duty of confidentiality to us who provide administrative, credit checking, payment processing, data processing, research and marketing, distribution, telecommunications, professional or other similar services to us for the purposes mentioned in clauses 2 and 3 above.

c) Our Subsidiaries when a Subsidiary’s participation is necessary to perform/complete an established transaction between us and the customer

d) Business partners we trust, any disclosure and responsibility for the confidentiality of your personal data will be done by agreement between us and the business partners.

e) A third party or to a competent authority when required by the competent authority, or in other circumstances as required by law, or we have reasons to believe that the disclosure of personal data may protect rights, property or safety of the Customer or ours or our Subsidiaries’.

f) Other parties with your consent or at your instructions.

2.4. We may also disclose and transfer (whether in Myanmar or abroad) to any of our actual or proposed assignees or transferees of our rights with respect to your personal data in connection with a re-structuring of our retail business, and/or merger (as between us and a third party), sale, or transfer (whether of assets or shares, in whole or in part), to use, hold, process or retain such personal data for the purposes mentioned in clauses 2 and 3 above.

3. Browsing information collected from you (Cookies)

3.1. We use cookies and similar technologies to collect information about your use of our website and our other related websites (“Sites”). We use cookies to give you the best possible experience on our Sites.  Some cookies provide core site functionality (e.g. to provide secure log-on or to facilitate standard on line ordering processes.  Others enable us to evaluate the use of our Sites and review your browsing and shopping habits, to measure and improve performance and to personalize your website experience.  We also use cookies such as Google Analytics or similar tracking services, in order to offer you tailored content which may be of interest to you based on your prior activity on our Sites.

3.2. The types of data we may collect from you when you visit the Sites include:

–         Information about the type of browser you use;

–         Details of the web pages you have viewed;

–         Your IP address;

–         The hyperlinks you have clicked;

–         The websites you visited before arriving at our Site; and

–         Other related information regarding Site usage.

3.3. You may refuse to accept Cookies (by modifying the relevant Internet options or browsing preferences of your device), but to do so you may not be able to utilize or activate all of the functions and services of our Sites.           

4. Your rights in relation to your personal data

4.1. You have the right to:

  1. Check whether we hold any of your personal data;
  2. Access your personal data held by us;
  3. Require us to correct any personal data which is inaccurate;
  4. Ascertain our policies and practices (from time to time) in relation to personal data and the type of personal data held by us;
  5. Opt out from receiving direct marketing materials from us at any time.
  6. Should you have any enquiries or request in relation to the above, please contact our Customer Service Hotline, which can be found on our website.
  7. In accordance with the applicable data privacy laws, we may charge you a reasonable fee for the processing of any Personal data access request.

4.2. Customer’s Responsibility

a) Read this Policy carefully before using the product or accessing the service. The use of and access to our services by the Customer is also the confirmation of having thoroughly researched and agreeing to the entire content of this Policy;

b) Provide accurate, legal information when requested and agreed to provide. You will be solely responsible (in all cases, with no connection to us, in whole or in part) if the Customer Information provided to us is inaccurate, illegal and / or Customer’s performance of the Service is interrupted, unable to perform; or transactions between us and the Customer, between us and a third party, between the Customer and the third party are interrupted or impossible due to technical factors, transmission lines, system errors, etc. or arising from any material or non-material damage resulting from the use of the Information inaccuracies / violations of this law;

c) Do not use any programs, tools or any other form to interfere with the system or change the data structure of the Service, the interface of the website, the existing features of our website;

d) Do not distribute, propagate or support any activity aimed at interfering with, sabotaging or accessing data of the website system under our control;

e) Do not disseminate, distribute any content that violates the law and/or social ethics on our website;

f) All violations will be handled according to the provisions of law.

4.3. In accordance with the applicable data privacy laws, we may charge you a reasonable fee for the processing of any Personal Data access request.

5. Protecting your personal data

5.1. We maintain appropriate technical and organizational measures to protect the personal data you provide to us against accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to your personal data.

5.2 Our Website may contain hyperlinks to other websites provided by third parties. We do not control these third party websites or any of the content contained on those websites.  Once you have left our website, we cannot be responsible for the protection and privacy of any information which you provide.  You should exercise caution and look at the privacy statement for the website(s) you visit.

5.3. We will apply appropriate technical and security measures and solutions to best protect your personal data. However, note that while we have taken reasonable measures to protect your personal data, no website, internet connection, computer system or wireless connection is absolutely secured. Therefore, we cannot make a firm commitment that the information provided by the Customer will be kept absolutely secured, and we cannot be held responsible in the event of unauthorized access, or any leak of Customer Information without our direct fault. If you do not agree with the terms as described above, you are recommended not to provide your personal data to us. 6. Other terms and conditions

6.1. If there is any inconsistency or conflict between the English and Myanmar versions of this Privacy Policy Statement, the Myanmar version shall prevail. 

6.2. This Privacy Policy Statement shall be governed by, and construed in accordance with the laws of Myanmar.

6.3. We may change this Privacy Policy Statement from time to time by posting an updated version on our website.
